As above, the tester can fail the exhaust if the noise is 'clearly in excess', of what would normally be expected.
Wether it's a perormance enhancing exhaust or not is irrelevant, though if the tester sees 'not for road use' on it (as some aftermarket bike pipes do, not noticed it on any scooter ones), it will fail.

There is a legal dB limit for exhausts, but it varies dependant on the scooters year of manufacture. I'd expect a Simo to pass though assuming it's in good condition. Any exhaust stamped with the BS or Euro standard mark is an automatic pass as they are manufactured to be within the legal limit. If you want a really good argument with an MOT man, try turning up with an open mouthed carb... you get a hell of a lot of unsilenced noise back through those on any aircooled engine, but AFAIK it still isn't an MOT failure
